Course Description

Daily attorneys operate their practice in fear of not only a disciplinary complaint being filed against them, but a legal malpractice suit being brought by a client. Unfortunately, for one attorney or another, these fears are realized daily. At the root of these malpractice claims are allegations premised on some ethical violation. It could be as simple as a failure to communicate. Some attorney mistakes and oversights are costlier than others. Whether it’s your license on the line or a big payout day, learn from the mistakes of others and try not to make them yourself. This CLE will examine the elements that must be met for success in a legal malpractice action, the cases that survived a motion to the dismiss for failure to state a claim or for summary judgment based on the law and the ones that did not. What were the differentiating factors and what were the common alleged violations?
